• Charger Services Agreement

    The following is an agreement (this “Agreement”) by which you can be paid by Bird Rides, Inc. (“Bird”) for providing charging services (“Bird Charger Services”) on a contractor basis. Please read through all of the terms of this Agreement. You may enter into this Agreement by indicating your acceptance through clicking the appropriate button on the Bird mobile app.

    If you enter into this Agreement, Bird will send you a charger cord to you with a postage paid return envelope. You will be charged $10.00 as deposit for the cords, and the deposit will be returned to you when you return the cord(s) to Bird. If you lose or do not wish to use the return envelope, click here for the address to which cords can be returned.

    Once you have entered into this Agreement and received a Bird charger cord, you can provide Bird Charger Services by clicking the “Bird Charger” button on the Bird App and entering or scanning the Bird Scooter code into the App. The Bird Scooter will unlock, so that you may take and charge the Bird Scooter. If you unlock a Bird Scooter through the Bird Charge button, you agree to perform the following services:

    • Pick-up and move Bird Scooter to a charging location that you own or lease;
    • Charge the Bird Scooter to a 100% charge; and
    • Return the Bird scooter to one of the Bird Nest areas by 7 a.m. the following day.

    The following requirements and limitations shall apply to the Bird Charger Services:

    • A Bird Scooter must be charged using only a  Bird charger cord that you receive from Bird;
    • You must not overload any electrical circuit while charging the Bird Scooter and will have a certified electrician review and approve your location for safely charging the Bird Scooters;
    • You must not use electricity that you do not pay for or otherwise have permission to use for the Bird Charger Services;
    • You must provide reasonable spacing and ventilation of Bird Scooters while charging to prevent overheating of the Bird Scooters or their chargers; and
    • You may not charge more than 20 Bird Scooters during any calendar day.


    If you perform the Bird Charger Services, Bird will pay you five cents ($0.05) for each percent of charge fed to the Bird Scooter. For example, if Bird Scooter is picked up with a 20% charge and returned with a 100% charge, Bird would pay you $4.00 ($0.05 x 80). If the Bird Scooter is returned to Bird Nest after 7:00 a.m., the following day, the consideration will be reduced by one-half.


    You will be responsible for and pay all expenses that you incur in connection with the Bird Charger Services, including without limitation transportation, facilities, and electricity expenses. Consultant is authorized to incur any expenses on behalf of the Company.

    In performing the Bird Charger Services, you are a contractor of Bird, and subject to the limitations above, you can determine the method, details and means of performing the Bird Charger Services. You acknowledges and agree that (i) you have no authority to enter into any agreement or contract that binds Bird or creates obligations on the part of Bird, (ii) you are not be eligible for any Bird employee benefits and, to the extent that you otherwise would be eligible for any Bird employee benefits except for the express terms of this Agreement, you expressly decline to participate in such Bird employee benefits.


    You have full responsibility for all applicable taxes for all compensation paid to you for the Bird Charger Services, including any withholding requirements that apply to any such taxes. You agree to indemnify, defend and hold Bird harmless from any liability for, or assessment of, any claims or penalties or interest with respect to such taxes, labor or employment requirements, including any liability for, or assessment of, taxes imposed on Bird by the relevant taxing authorities with respect to any compensation paid to you. any liability related to the withholding of such taxes.


    This Agreement shall be governed, construed and interpreted in accordance with the laws of the state of California, without giving effect to principles of conflicts of law. If you earn more than $500 in any calendar year, you will be required to complete and submit an IRSD Form W-9 to Bird.


    If one or more provisions of this Agreement are held to be unenforceable under applicable law, then (i) such provision shall be excluded from this Agreement, (ii) the balance of the Agreement shall be interpreted as if such provision were so excluded and (iii) the balance of the Agreement shall be enforceable in accordance with its terms.
