These guidelines assist law enforcement officials seeking information from Blue Jay Transit, Inc. and our affiliate or subsidiary companies (collectively, “Bird”). Bird may modify these guidelines without prior notice.
About Bird
Bird operates an application, website, and technology platform that provides users (“Riders”) with access to personal electric vehicle rentals.
Contacting Bird
Bird accepts law enforcement requests only via email at subpoenas@bird.co. Acceptance of a request does not waive any legal objections Bird may raise. Requests should be addressed to Blue Jay Transit, Inc. directly.
Business Records
Bird maintains information in accordance with its Privacy Policy, Rental Agreement, and Terms of Service. Ride receipts include the ride date and time, ride start and ride end locations, route, and fare breakdown. Riders can access their trip history via the “Ride History” feature in the Bird mobile app.
Legal Process Requirements
Bird requires valid legal process before disclosing business records regarding Riders in response to law enforcement requests. Valid legal process includes a valid subpoena, court order, or search warrant. Exceptions may apply for emergencies involving a threat of death or serious harm, rider consent, or other regulatory requirements.
Preservation of Records
Upon receiving a formal written request, Bird will take steps to preserve — to the extent we have any — information responsive to the legal process.
Emergency and Exigent Requests
For emergencies involving a threat of physical injury or death to a person, law enforcement may submit a request to subpoenas@bird.co with the subject line “Emergency Disclosure Request,” including detailed incident information. Bird reviews these requests on a case-by-case basis and may, at its sole discretion, provide responsive information.
Form of Request
Requests must include:
- Legal basis: the applicable law and specifics of the investigation.
- Detailed information sought: date, time, location, and rider or charger identifiers (email addresses). Bird cannot search by proper names, credit card numbers, PayPal accounts, or billing addresses.
- Requesting officer details: name, title, issuing authority, badge/ID number, telephone, street address, and an official government-domain email.
Valid requests must be:
- Typed in non-editable form;
- Signed by an authorized law enforcement officer;
- Compliant with local and U.S. law; and
- Addressed to Blue Jay Transit, Inc. directly.
Foreign Requests
Bird may respond to international law enforcement requests if there is a valid legal basis for such requests, within applicable legal constraints.
Hate Crime Commitment
Bird is committed to cooperating with law enforcement pursuing Riders or other business partners who are reasonably suspected of being involved in a hate crime, including by providing all available data.
Notice of Requests
Bird notifies affected riders and partners of legal requests, except when (a) prohibited by law or (b) Bird, in its sole discretion, believes that providing such notice could create a risk of physical injury or death. Law enforcement seeking non-disclosure should provide an appropriate court order or statutory authority, sufficient detail about the potential harm, or withdraw the request in a timely manner.
